Personal Data Processing Information
art. 18, Federal Data Protection Act (LPD), 25 September 2020
Pursuant to Art. 18, of the Federal Law on Data Protection (LPD) of 25 September 2020, herein is provided the relevant information regarding the processing of the provided personal data that is required for establishing any sort of business relationship with OVERTECH GmbH.

2. Purpose of the personal data processing
Personal data is processed in order to:
(a) implement contractual relationships with OVERTECH GmbH to adequately fulfill any related obligations, whether civil, fiscal, accounting, or insurance, and any inherent and consequent responsibilities;
(b) manage the administrative, fiscal, and accounting obligations of the company that result from any contractual relationships;li e contabili della società conseguenti ai rapporti contrattuali in essere.

(d) ensure the protection of the company's rights and/or interests in the event of any administrative and/or judicial proceedings.
The related processing of personal data must be legitimized by explicit consent of the interested party (art. 6, LPD of 20 September 2020) only if such personal data may reveal sensitive information: i.e., the racial or ethnic origins, religious orientations, etc. of the individual.
3. Legal basis for processing the data

(a) execution of a contract with OVERTECH GmbH (art. 6, LPD of 20 September 2020);
(b) fulfillment of legal obligations applicable to the execution of a contract (art. 6, LPD of 20 September 2020);
(c) pursuit of a legitimate interest of OVERTECH GmbH (art. 6, LPD of 20 September 2020).
4. Recipients of personal data
Recipients of the personal data will be:
(a) employees and associates of OVERTECH GmbH;
(b) customers, suppliers, and associates of OVERTECH GmbH;
(c) external accounting and tax consultancy firms;
(d) banking and insurance institutions;
(e) judicial and other public authorities.
Some of the recipients listed above may receive the data outside Switzerland in states where the Federal Council has previously recognized the existence of data protection systems.
5. Data retention period
Personal data will be retained for the entire duration of the contractual relationship in place with OVERTECH GmbH and for the entire period following its termination until the data is no longer necessary for the fulfillment of legal or contractual obligations and is no longer necessary for any purposes regarding protecting the company before any judicial and/or administrative authority. The data, therefore, will be deleted when any possible need for protection as indicated above is extinguished, or due to the expiration of the rights connected to such protection.
6. Automated decision-making processes
Personal data will not be processed with automated decision-making processes.
7. Rights of the interested party
The individual to whom the personal data belongs has the right to exercise the following:
(a) Right to access their personal data
The individual has the right to confirmation by the data controller regarding whether or not their data is being/has been processed and, if so, they have the right to obtain access to their data.
The individual has the right to the rectification by the data controller of inaccurate data concerning themselves, as well as, the right to the integration of incomplete data in accordance with the purposes for which the data is being processed.
(b) Right to erasure of personal data
The individual has the right to have their data canceled by the data controller, provided such data is no longer necessary for the purposes for which it was collected or otherwise processed, or in the event the data was processed unlawfully or if the cancellation of the data constitutes compliance with a legal obligation under the laws of the Swiss Confederation.
The individual has the right to object at any time to the processing of personal data that is necessary for the data controller to pursue a legitimate interest. This right is forfeited if the data controller demonstrates the existence of compelling legitimate reasons that prevail over the rights and freedoms of the individual and/or if the need exists to process the data for the purposes of ascertaining, exercising, and defending a claim in court.
(d) Right to have personal data provided or to request its transmission to third parties
The individual has the right to receive data from the data controller or to obtain transmission by the data controller to another data controller, personal data provided by and concerning themselves that has been automatically processed, provided that this does not infringe the rights and freedoms of others.
(d) Right to file a complaint
In the event that the individual believes the processing of their personal data violates the LPD of 25 September 2020, they have the right to file a complaint with the competent supervisory authority.
